doj sues utah over in-state tuition for undocumented students
Utah law has allowed certain undocumented students who graduate from a Utah high school and meet other requirements to pay in-state tuition since 2002. The Justice Department argues the policy violates federal law.
Utah is facing a federal lawsuit over its policy allowing qualifying undocumented students to pay in-state tuition at public colleges and universities.
The U.S. Department of Justice filed the lawsuit September 10, arguing the policy conflicts with federal law by offering tuition benefits to undocumented students that are unavailable to some U.S. citizens from other states.
Utah’s law dates back to 2002. Eligibility includes attending a Utah high school for at least three years, graduating or earning an equivalent diploma, and meeting additional requirements.
The DOJ is asking the court to block the challenged policies. Filing a lawsuit does not itself overturn the law.
