utah joins ftc in suing restaurant tech company 'toast' over alleged hidden few and "$0" claims
Utah and six other states say Toast misled restaurant owners on pricing, support and cancellation; Toast says it will fight the case.
Utah is joining the FTC and several other states in suing Toast.
The lawsuit alleges the restaurant technology company misled businesses about pricing, customer support and hidden fees.
According to the complaint, Toast advertised $0 point-of-sale products that allegedly weren’t actually free, promoted “24/7/365” customer support that some restaurants reportedly struggled to access, and charged fees that weren’t clearly disclosed.
Some early termination fees could allegedly reach between $5,000 and $17,000
The complaint also claims Toast collected certain online-order fees without customers’ consent.
Toast strongly disputes the allegations and says it plans to “vigorously” defend itself. The company argues the FTC is applying federal consumer protection law to negotiated business-to-business contracts in an unprecedented way.
The lawsuit is seeking civil penalties, damages and a permanent injunction.
A lawsuit represents allegations that have not yet been proven in court.
